On Thursday, September 21, the Kyiv Court of Cassation began consideration of the cassation complaint of a border guard Kolmohorov, who had been earlier sentenced to 13 years of imprisonment by the Mariupol Court of First Instance. The corresponding decision was subsequently supported by the Court of Appeal of Donetsk region.
People’s deputy from the Samopomich Union faction Taras Pastukh tells the details: “The border guard started his service under the contract; following the order, he arrived at the place of service and, following the order, stopped the car, which was transmitting unknown signals and had not stopped at the request of the entire frontier service. As ordered, all the soldiers at the checkpoint opened fire to stop this car. One passenger died. As a result, the border guard was sentenced to 13 years not as a military man, but as a civilian under the articles of intentional murder and abuse of authority.”
The MP believes, “This criminal verdict might not be the only one, because today the Military Prosecutor’s Office is intensively investigating such criminal cases against our servicemen, while ignoring the cases against those who invited Russia here. Today it turns out that the people who stopped Putin’s aggression, stopped his supporters in the east and used weapons had no right to do so, according to the military prosecutor and the above mentioned courts. Finally, notorious Nelia Shtepa is at large, while the border guard has been condemned.”
Therefore, Taras Pastukh says, our military men will be tried for such crimes as civilians until the Verkhovna Rada legally recognizes the occupation of our territories by Russia, and the President makes submission to the Verkhovna Rada on the use of the Armed Forces.
So far, the MP concludes, the authorities have no answer regarding how to protect the legitimate rights of Ukrainian servicemen.
